Superior Engineering - Warranty Policy

The Goods of Superior come with the guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure.
You are also entitled to have the Goods repaired or replaced if the Goods fail to be of acceptable quality.

1.Superior’s Warranty as to Goods
(a)Superior warrants that all Goods will be free from defects in material and workmanship. Goods are covered with a warranty for a period of twelve months from the date of purchase by the Customer (Warranty Period). Where Superior determines that the warranty applies, Superior will at its election, repair, refund or replace the Goods pursuant to its obligations under the Consumer Law.
(b)All defective Goods replaced by Superior under this warranty will be deemed to be the property of Superior.

2.Manufacturer’s Warranty
Where Superior is not the Manufacturer of Goods:
(a)it warrants that the Goods will be free from defects in materials and workmanship on the same terms and conditions including the period of warranty as the warranties provided by the Manufacturer of the Goods;
(b)if the Customer makes a warranty claim, Superior may at its option return the Goods to the Manufacturer to be determined by the Manufacturer if a major or non-major failure of the Goods has occurred.
(c)Should the Manufacturer determine that a major or non-major failure of the Goods has occurred, Superior will at its election, repair, refund or replace the Goods pursuant to its obligations under the Consumer Law.

3.Exceptions to Warranties
(a)Superior may inspect and test the Goods for the purpose of determining the extent of any defect and the validity of any warranty claim.
(b)The warranties in this policy do not apply to Goods:
(i)no longer required by the Customer;
(ii)incorrectly chosen by the Customer;
(iii)where there is no original proof of purchase;
(iv)on the basis of Customer opinions regarding ride, comfort, installation or design;
(v)to the extent the damage is to finish/coating, and occurs after the earlier of the Goods being fitted to the Customer Equipment, or 60 days after being sold to the Customer, whichever comes first.
(c)The warranties in this policy do not apply where, in Superior’s opinion, the damage to the Goods has arisen due to:
(i)any modification or alteration by the Customer or any third parties (including changing colour, welding or attaching additional parts, or grinding);
(ii)misuse of the Goods by the Customer of any third parties including but not limited to vehicle overloading, neglect, lack of maintenance, over- or under-greasing, lack of lubrication or excessive lubrications, or improper installation;
(iii)normal wear, including to bushings, bump stops, ball joints, tie rod ends and heim joints;
(iv)use outside of physical, mechanical, electrical or environmental specifications;
(v)failure to follow recommendations or instructions;
(vi)use in racing;
(vii)abrasion, collisions, or traffic accidents;
(viii)leaf or coil springs being used without proper bump stops at the correct distance. Coil springs must be more than 15mm free height sag to qualify for this warranty, but this will depend on the specific brand and their warranty policy;
(ix)shock absorbers used without proper bump stop adjustment;
(x)use with accessories including consumables, hardware and equipment of other manufacturers; or
(xi)otherwise the fault of the Customer.
(d)Remote Reservoir, IFP, ECDS Shock Absorbers are considered serviceable shocks with a two-year/unlimited Km warranty. Rebuild service and replacement parts will be available and sold separately by Superior.
(e)Nitro Gas Twin Tube Shock Absorbers are considered non-serviceable shocks with a three-year/unlimited Km warranty.
(f)The warranties in this policy do not cover labour for installation of replacement parts, or refitting parts, even where they were incorrectly supplied by Superior Engineering.
(g)Superior cannot warrant a lifetime warranty for a Superior steering rod that is less than 10mm in 1000mm in bend. Superior Control Arms also cannot be warranted if they have less then 5mm in 1000mm bend.

4.Packing Materials
If Goods are returned in damaged or not the original packaging, Superior may deduct the cost of the packaging from any refund provided to the Customer.

5.Modifications
The Customer acknowledges that some modifications and installations of Goods, including suspension kit heights, may result in the Customer’s Vehicle being illegal to operate for road use in a State or Territory of Australia. The Customer acknowledges and confirms that they have undertaken their own investigation into the legality or otherwise of particular Goods, including suspension kit heights, with the relevant transport authority of the Customer’s respective State or Territory. The Customer indemnifies and holds Superior harmless from and against any Claim as a result of the legality or otherwise of Goods installed or modified by Superior.

6.Rubber Bushes
(a)Where possible Superior uses Genuine Original Equipment (OE) bushes in our suspension components. If for any reasonable circumstance Genuine OE bushes cannot be sourced from Australian suppliers, Superior will endeavour to supply bushes of equivalent quality.
(b)The Customer acknowledges that vehicle manufacturers such as Nissan Australia and Toyota Australia have a provision in their warranties that no bush will be covered under warranty when installed in an ‘aftermarket’ suspension component, or fitted in any ‘lifted’ vehicle.
(c)Superior offers a 3-month warranty on Genuine OE bushes and a 6-month warranty on Superior bushes that are supplied and fitted to our suspension components such as Radius arms, Panhards, and rear control arms. Superior bushes are 100% made in Australia and after years of testing have continually proven to outlast Genuine OE bushes.
(d)Please note that Superior products may be supplied with either style bushings, which is purely dependent on the availability from manufacturers and may vary across batches. The warranties are applicable on all associated components and will be valid from the date of initial purchase. The warranty applies to bush failure from manufacturing defects; however, it does not cover abuse or over flexing of rubber bushes outside what would be considered common use.

7.Making a Warranty Claim

The customer must return the Goods to Superior and provide a written statement or email outlining the issue or defect in sufficient detail so that Superior and/or the Manufacturer may investigate the claim.
